l have two roommates, and one is leaving for the military in a few weeks.
If he breaks the lease because he is leaving for the military, will it break the WHOLE lease (for all three of us), or just HIS part of the lease?

People have told me that it will just break HIS, but my two roommates are telling me otherwise.

l just read my lease, and l did not read anything that involves anything military.

And all three of our names are on the lease.
l forgot to add this, but the whole point of breaking the lease is because when the Male roommateleaves, my OTHER roommate wants to move out, back to where she used to live. Leaving only me, and l can not afford the rent+utilities all by myself.

You need to read the lease. If all three of your names are on the lease, then you will likely have to sign a release for him to be off the lease. If your names are not on the lease, then it will break for all three of you.

If ur roommate leaves for the military, if u check the laws, u will see this:
With a normal lease, ur landlord is under no obligation to let u break ur lease just because u have received new orders. When u enter into a lease agreement, be sure ur lease has a military clause in it.

If the military clause is provided, that would leave the remaining two lease holders to pay for rent or find a suitable replacement.

However ur roommate who is leaving should put in his written notice, otherwise he stays on the lease & could get into legal issues if the lease ever goes default.

l would check ur state law however, some states has a set law that all landlords but abide by. Give the attorney generals office a call.

If you and your remaining room mate are going to stay and make the rent payments then the landlord will not be concerned. Just make sure you abide by the terms of the lease.

Since he is the only one with the orders, he will be released from the lease. Its usually under the military addendum for the lease. You & ur roommate will be the sole residents on the lease.

At my apt community if we have a situation like that, the one with the orders will be taken off the lease. You & ur roommate will stay on the lease but if ur roommate wants out we have to make sure that financially u can pay the amount of rent each month, & u both have to agree to take the other off the lease.

If ur roommate wants out to move back home, make sure u take a look at the lease & talk to the office to see what ur options r to break the lease. Its always better to talk to the apt office to make sure u know all of ur options before u decide anything.
