l receive a 3 day notice or quite letter from my land lord on oct on the envelope its stamp on2nd l do not remember what date l receive that letter does the stamp mean l received it on that date? anyhow l always pay my rent on the 7th but since this is a new land lord l wasnever inform that the rent was due on the 1st. l made a money order and sent his rent on the 8th but today he came to my apartment and return the money order and said he could not accept my rent because it was late he asked me to call him later but his not answering my calls does that mean he will order an eviction form on me what can l do if l wanna stay in this apartment i'am a single mother and can not afford the really high rents im a low income mom help please

Sounds like a real idiot make sure you keep that money order and if he attempts to evict you then show the judge this money order and that you did try to pay your rent and he said no and tell the judge when he took over he never stated the due time changed. It is hard to evict someone and with children even harder. ask for help from public defender look it up in the yellow pages. Good Luck Remember some landlords are just scumbags

Once the 3 days have past and your fail to pay, the landlord can legally proceed with the eviction. You may be able to stay in the property if you show up in court with all back rent, late fees, court costs and attorney fee. Even if you do not have the money, make sure you show up in court. The judge may give you extra time to get out..rather than the usual 72 hours you would get if you did not show up.

Yes, he is evicting you. He had to accept ur rent during the 3 day period, but not after.

If ur lease states that rent is due on the 7th then he can not evict u for late payment. If the lease has no date it is due the 1st (99% of the time rent is the 1st).

If he does evict u u can ask the judge to force him to rent to you. You stand very little chance of that, as that is rather Dictatorship & does not happen that often (depends on ur state). You can also ask for more time to move out, 5 days is the norm, but a judge can order another week be given.
